Artificial intelligence (AI) is changing our society and economy at a rapid pace. Smart assistants, automated business processes and intelligent data analysis are increasing efficiency and productivity. In order to create clear guidelines for the use of AI, the European Union has adopted the AI Act, the world’s first comprehensive AI regulation. This regulates the use of AI on the basis of a risk-based approach in order to reconcile innovation and safety.

What does the EU AI Regulation regulate?

The regulation distinguishes between four risk classes:

Unacceptable risk – Prohibited applications
AI systems that pose a risk to fundamental rights are prohibited. These include
– AI-supported influencing of human behavior
– Emotion recognition in the workplace
– Facial recognition from internet or surveillance images for database creation

High risk – strictly regulated applications
AI systems in sensitive areas such as healthcare, law enforcement or finance are subject to strict regulations and must meet high security and transparency standards.

Limited risk – transparency obligations for users
AI systems that interact with humans (e.g. chatbots or deepfakes) must be clearly recognizable as AI to ensure transparency.

Minimal risk – largely unregulated applications
Most AI-supported solutions, including many smart home applications or automated customer services, fall into this category and are subject to hardly any restrictions.

When does the EU AI Regulation apply?

Chapters I (General provisions) and II (Prohibited practices in the AI sector) of the AI Regulation have already been applicable since February 2, 2025 (sentence 3 lit. a)).

  • In accordance with Article 56 of the AI Regulation, the practical guides must be ready by May 2, 2025 at the latest.
  • From August 2, 2025:
    • Chapter III, Section 4 (Notifying authorities and notified bodies),
    • Chapter V (AI models with general purpose),
    • Kapitel VII (Governance)
    • and Chapter XII (Sanctions)
    • and Art. 78 (confidentiality) apply (sentence 3 lit. b)), with the exception of Art. 101 (fines for providers of general purpose AI models).
  • Art. 6 para. 1 (Classification rules for high-risk AI systems) and the corresponding obligations under the AI Regulation will not apply until August 2, 2027.

What are the challenges and opportunities for companies?

For companies, the regulation means that they must carefully examine their AI-supported processes and adapt them if necessary. There are new requirements – but also opportunities – particularly in the areas of IT security, data protection, compliance and automation.
